   This site is owned and operated by ToJo 4wd Centre, and unless otherwise specified all material appearing in this site, including the ToJo 4wd logo, text wording, site design, graphics, icons, images, photographs and any other material content as well as the selection, assembly and arrangement is therefore subject to any applicable copyright laws. You may use the content of this site for the intention of shopping online, placing an order or for informative read only purposes. No material content from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without the prior written permission of ToJo 4wd Centre. Any unauthorised use of the content material appearing away from this site may violate copyright, trade mark and other applicable laws and could result in criminal or civil penalties.

   ToJo 4wd Centre expressly disclaims all warranties, express or implied, of any kind with respect to products sold in this site, including but not limited to merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to ToJo 4wd Centre arising from any product sold to you from this website shall be the price of the product ordered. In no event shall ToJo 4wd Centre, it's directors, employees and representatives be liable for special, indirect, consequential or punitive damages related to the products sold.

   To the extent permitted by law, you release and discharge ToJo 4wd Centre, it’s directors, employees and representatives from all forms of direct, indirect or consequential losses or damage (including loss of profit, loss of data or other intangible losses) arising out of or in connection with ToJo 4wd Centre or your use of this site, including loss or damage to goods in delivery or that caused by the negligence of ToJo 4wd Centre, it’s directors, employees and representatives. 

   You agree to indemnify and hold ToJo 4wd Centre, it’s directors, employees and representatives exempt of any claim or demand, including reasonable legal fees, charge backs and unauthorised credit card transactions, made by you or any third party due to or arising out of the content you submit to or transmit from this website, your use of this site, your connection to this site, your violation of the Terms of Use.

 

   Order Agreement Policy

   Your receipt of an electronic form of ordering confirmation does not neccessarily signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. ToJo 4wd Centre reserves the right at any time after receipt of your order to accept or decline your order. If an item's retail value requested as an order is less than $15.00 this order may also be declined depending on the freight component charge.

   In the event that we cannot fulfil your order or some items within the order cannot be shipped within 7 business days, we will notify you immediately by email as to whether the goods you require are to be backordered or whether you wish a credit refund, or alternatively if the goods can be sourced from a supply from Toyota Australia if available, with the difference in price notified by email.

   

   Payment Options 

   All prices are in Australian dollars and are applicable to Australian GST. All online orders must be paid for by Visa, Master Card or any other major credit / debit card. There is no surcharge for using your credit card to make purchases with ToJo 4wd Centre unless otherwise stated. Paypal is also available for customers who wish to use this facility however there is a 2.4% surcharge on the total amount for all Australian orders and 3.6% surcharge on the total for all international orders. 

   Please be sure to provide your full name, exact billing address, email address and telephone numbers, any incorrect information may cause a delay in processing your order. Your credit card will be billed as soon as your order is placed, this is done to protect the security of your credit card details.

   In order to process any online shopping transactions, we may share this information with your own financial institution and the Commonwealth Bank CommWeb Secure merchant facility, however no credit card numbers or authorisation codes are stored in our system at any point. The credit card details are passed onto the Commonwealth Bank mechant e-commerse gateway as soon as full payment has been collected.

   Bank cheque or Australia Post money order option can also be catered for by us at ToJo 4wd Centre for customers who do not have credit cards. This scenario requires you to email us with your full name, delivery address, contact phone number, a complete parts list, any applicable insurance if required and your prefered delivery. A quote will be emailed, valid for 30 days, in responce, and on receipt of payment (personal or business cheques will not be accepted) goods will be dispached with a processed invoice.

  Bank to bank transfer method is also available for customers who require more immediate part requirements and who prefer internet banking to credit cards. Email us with your full name, delivery address, all contact phone numbers, full parts list, if any insurance is required and how you wish the products to be delivered. If you indicate to us that you require this method of payment, we may contact you for identifications reasons before we email a return quote, valid for 30 days, and on receiving a transferral statement of payment we will promptly dispach your invoiced goods.

 

   Warranty and Refund Return Policy

   Please choose your products carefully, as we do not refund processed and despatched orders unless they are compromised in some way or unless otherwise stated. Returns are only available for despatched orders that contain supplied goods that are wholly or partly defective in appearance, incorrectly packaged or sent in error by fault of ToJo 4wd Centre, or the goods fail to operate in accordance to their specification or duration period. 

   Should the need arise to return a product or products please advise us by phone or text us on 0423 796 372 or email us at tojo4wdparts@gmail.com within 7 days of the date of receipt of your order. ToJo 4wd Centre will resupply your order promptly or any part thereof freight free in instances upon receipt of the returned goods which are in error by fault of ToJo 4wd Centre or obviously defective from manufacture.

   Warranty returns which are in question of being faulty in appearance or performance by the customer are subject to our initial inspection and will be forwarded on to our supplier for a full warranty claim. If an immediate substitute part is required, the replacement item plus freight costs will be need to be purchased by the customer again until the warranty claim can be fully processed by our supplier.    

   In the event of an exchange part return, warranty claim credit or refund we will contact the customer directly either via phone or email for details of reimbursement preferably using secure online bank to bank transfer method. 

   To assist us with any returns please provide us with the following details: your full name and address, product details, invoice number, date of purchase, and the reason for return. Upon receipt of this information we will contact you with the preferred method of goods return if the item cannot be returned by post.

   Delivery and Order Information

   Postage cost will depend on the total weight of the products ordered and the delivery destination. This cost is calculated once your order has been processed and will be advised at the time of payment if the total weight of products ordered is less than 22kg. The maximum allowed weight of a single parcel lodged at an any Australia Post outlet is 22kg, with the parcel length not exceeding more than 1.4 cubic metres. 

   When the checkout weight of goods is over 22kg, the shopping cart facility will allert us to calculate a new freight cost. The variance here is that goods may be split into 2 or more parcels either using Australia Post, or alternatively another courier service may be used to deliver one heavier or longer box. We will view the products in your shopping cart, work out the best alternative for delivery in your favour and add this cost to the freight component for you to continue with finalising your order. 

   All orders delivered by Registered Australia Post or via a courier service will require the customer's or a recipient’s signature on delivery. Please provide an actual daytime delivery address, a business address or place of employment and a daytime phone contact where you or a third party are able to sign for the parcel's delivery.

   If you are unable to sign for your parcel Australia Post or the courier service will advise you at which Australian Post retail outlet or freight depot you will have to collect your parcel from and the time that it will be available for collection. You will be required to sign for Registered goods with P.O. Boxes or rural mail services via Australia Post at your local Australia Post outlet. 

  

   Property and Risk Policy

   All goods ordered, paid for in full and have been despatched from our premises become the property of the customer and all risk of lost or damage in delivery is transfered to the customer or to the customer's preferred freight provider. ToJo 4wd Centre offers all customers the option of Registered Australian Post for compensation for loss or damage to goods up to $100 for a standard registered delivery and Extra Cover insurance option for items between $100 to $1,000.   

    Orders are securely packed to prevent minimal damage to goods during shipping and are handled with the utmost care at our dispatch, however our responsibility for any damage to goods or loss of goods during delivery ends when an order has left our premises. We hereby advise customers to use Registered Australia Post or adequately insure goods of a fragile manufacture, i.e. door glass, plastic lights and mirrors, body panels and trim, at all times during delivery up to their full retail replacement value. Most freight companies do not offer insurance compensation for lost or damage to goods that that are classified as fragile, glass or electrical.

  Customers who receive insured items with missing or damaged contents should inform Australia Post immediately, and present the article including all wrapping and packaging to their nearest retail outlet for inspection. Australia Post Extra Cover insurance is only available within Australia and only with Registered Post delivery. For overseas deliveries, Australia Post will only pay insurance claims for missing or damaged contents if the overseas postal administration can confirm the loss or damage by inspection.

  

   Privacy Policy

   At ToJo 4wd Centre, we are committed to protecting your privacy at all times and have implemented many security policies to help protect and keep information private and confidential. We will not be liable for any disclosure of your personal information to any third party not authorised under this agreement, unless the implication is beyond our control.

   The information that we collect from our customers is for limited purposes only, such as processing sale orders and for assisting us in logging a history of purchases for warranty reasons. This information is manually entered into our primary computer database to protect it from third parties or any other external source. At no point do we record credit card numbers, and all mono type credit card transactions slips from any telephone order are incinerated.   

   ToJo 4wd Centre may disclose any content, records or electronic communication to satisfy any law, regulation or government request; permit disclosure if necessary to operate the site. However we will endeavour to protect the rights and property of our directors, employees, third party providers or licensors, and the rights of our customers.     

   By using our website, you consent to the collection and use of this information by ToJo 4wd Centre, and you agree that all communications that we provide to you electronically will satisfy any legal requirement and that such communication can be achieved by email, and any order we receive via email from you constitutes a contract of supply that is bound by these terms of use.

  

   Applicable Law

   These Terms of Use constitute the entire agreement between ToJo 4wd Centre and you the customer or user, and are effective even if the agreement is terminated by either party. You agree to submit to having any of the provisions of the Terms of Use, any legal claim relating to this website, the products or services provided or any of the material content appearing within dealt with and governed by the internal laws within the state of Queensland, Australia.
